First Implied warranty

At the time of selling the moveable good the seller is giving the implied warranty that after buying the product the buyer will enjoy the quite possession of the product.

Example: Suppose I am buying a phone which price is 30000 tk from ABC shop. So the seller has to give me the warranty that I will enjoy the quite possession of the product. If I can’t it is his duty to change the product.

S.14: Implied condition as to title

Under this section there is one implied condition and two implied warranties are present.

Implied condition: At the time of selling the moveable goods the seller is giving the implied condition that he is the owner of the product or he has the right to sell the product, otherwise the seller will be in breach of implied condition as to title.

Example: Suppose Mr. Karim is selling Nokia phone in Banani showroom, so it automatically means that he is the owner of the products so he has the right to sell the Nokia phone.

II.  Implied warranty

When the warranty has not be expressed by the contractive parties but in order to regulate a particular situation the warranty either established by the govt. law or by the custom of the situation.

I.Express warranty

At the time of making the contract when the contractive parties expressing the warranty that is called express warranty.

Example: If Tamim buys a watch from Nafis and Nafis says that this has a warranty then it is express warranty.

II.  Implied Condition

When the conditions has not be expressed by the contractive parties but in order to regulate a particular situation the condition either established by the govt. law or by the custom of the situation.

Example: If 2 person are a contract of buying and selling of illegal drugs then it will be prohibited by the law of the country.

I.Express condition

At the time of making the contract when the contractive parties expressing the condition that is called express condition.

Example: If Rana expresses the conditions of the contract to Iftekhar at the time of making it then it is express condition.

1) Condition

Conditions are the major term which has the major effect under the contract if there will be any breach of condition then the injured party will have only 1 option and that is to terminate the contract then and then.

Example: Condition is the  is  the main part of contract.

7) Other essential element

X or y at the time of making the contract the buyer and the seller has to declare that they are making the contract regarding a legal subject matter follow the rules and regulation.

Example: If Ashfaq is selling a CD to Iftekhar and making a contract then he has to declare that they are making the contract and the subject matter is legal.

6) Terms of the contract

X or Y at time of making the contract the buyer and seller has to tell each other each and every term of the contract.

Example: If Devdas wants to make a contract with Iftekhar then he have to tell every term.

5) Method of forming the contract

X or Y it can be made either by written from or orally or by conduct.

Example: If Laknath wants to make a contract with Iftekhar then he can make it written document or by orally words.
